Comentários sobre Realismo Escandinavo e Ponto de Vista Interno

Resumo:

Matheus de Barros escreve um esclarecedor e importante texto a respeito do que se convencionou chamar de realismo jurídico escandinavo, especialmente para defen- der alguns dos seus principais expoentes teóricos – Axel Hägerström e Alf Ross – de uma compreensão de suas teorias que ele julga incorreta. Barros pretende especialmente demonstrar que suas teorias não padecem de uma suposta falha que normalmente lhes é atribuída, qual seja, a não consideração daquilo que, a partir de HLA Hart, passou a ser designado como ponto de vista interno. Barros defende que a teoria de Hägerström e Ross contém “noções constituintes” do ponto de vista interno hartiano.
